Wedding Couple Representative (hereafter referred to as the “Client”).
This agreement contains the entire understanding between Premier DJs and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by both parties. This agreement is applicable for Weddings only.
Reservations
Upon your signature, Premier DJs will reserve the time and date agreed upon, and will not make other reservations for your assigned DJ for that time and date. For this reason, the Reservation Deposit of $220 is non-refundable, even if the date is changed or event cancelled for any reason, including acts of God, fire, strike, and extreme weather. The Reservation Deposit is to be paid at time of signing this contract. The Reservation Deposit is applied towards the contracted Event Package. Client understands and agrees that the entire amount owed for the Event Package described in the contract is due 14 days prior to the Event. Client agrees if the balance is not paid by this time, Premier DJs reserve the right to not perform at the Event, with a loss of Reservation Deposit by Client and no liability to Premier DJs.
Change of Times or Venue
Premier DJs must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of event. Notification of any changes can be made by phone along with written notice sent via email for documentation. If an email is sent, a confirmation of receipt must be in writing. It is the client’s responsibility to confirm all arrangements at least 7-10 days prior to the event. In the event of change of address or contact information (time, etc.) as listed, you must notify Premier DJs. Note that a change of venue and/or times may attract additional fees.
Venue
All events will be held indoors within a permanent weather proof structure, unless otherwise advised upon booking to Premier DJs. In the event that we are required to set up outdoors or be exposed to the elements, an additional Outdoor Contract must be signed by the purchaser.
Performance Time & Additional Time
Music commences at the scheduled start time agreed by both parties. Should additional time, that is not included in the agreed package, be requested by the Client, it will be charged out at the rates specified in the assigned Entertainment Package ($55 per half hour), rounded to the nearest half hour if booked prior to the event date. If additional time is requested on the day of the event, a rate of $65 per half hour (rouded to the nearest half hour) is payable in cash to the performer. Payment for this additional time is due either at the time of performance or on receipt of invoice for this addition. Payment of any fees additional to the assigned Entertainment Package amount must be paid within 7 days after the date of the event.
Payment
The Client agrees that the Reservation Deposit is required at the time of signing the contract and the Outstanding Balance is due 14 days prior to the Event, or on the Outstanding Balance Due date in the Event Package Summary, if specified.
Cancellation/Postponement
There shall be NO refund of booking fee after 48 hours from the signing of agreement due to the reservation of the event date. If the event is cancelled within 60 days of the event date, the client shall pay the balance of the contract. Once a balance is paid, it is NON-REFUNDABLE. Any other arrangements shall be discussed between the client and Premier DJs. All arrangements will be put in writing. Cancellation must be in writing and confirmed by both parties even if a phone call was made to inform Premier DJs of the cancellation. The client agrees to not expect a new date to automatically be available if the event is postponed. The client will be given the chance to reschedule but cannot be pushed ahead of other reserved clients.
COVID-19 Postponement Policy
Premier DJs understand and acknowledge the difficulty in planning a wedding and the impact that COVID-19 can add to this time. If a wedding needs to be postponed due to the impacts of COVID-19, we will roll your event (pending availability) to the new date in the future with no additional fees added (unless additional services or extra travel to a new venue is applicable). Any monies paid will stay in credit in your account.
House Rules
Premier DJs are limited by the guidelines of event officials and/or event location site management. The Client agrees to accept the results of their imposition on the DJ, including noise limits, music cut off times, lighting restrictions etc. Negotiation with the officials for moderation of guidelines is the Client’s responsibility. Premier DJs will not be liable for non-fulfilment of this contract as a result of the venue management’s requests and directions, however every reasonable precaution will be taken.
Co-operation of Guests and Other Service Providers
The Client is responsible for the conduct of the guests. Premier DJs will not tolerate verbal or physically abusive behaviour. If the Client is unable to control the conduct of the guests or if the conduct of any of the guests damages any of the equipment of Premier DJs, it will result in the early or immediate departure of Premier DJs. The Client understands that in such an event, no refund will be given. Co-ordination with other service providers may be necessary to complete the event as scheduled. The Client should share the contact details of other service providers with Premier DJs to make sure that there are no conflicts on the day.
Damages
The Client is responsible for any damage to our equipment caused by any person at the event. The Client will be charged for the full cost of any repairs / replacement and expenses incurred during the repair period. The Client will be advised of any damage as soon as it is caused and notified of the repair cost as soon as possible.
Venue Access & Set Up of Equipment
Premier DJs will have access to the event facility a minimum of 1.5 hours prior to the music start time to set up and test equipment (unless otherwise arranged with venue staff). Premier DJs require sufficient floor space which would allow the audio and lighting equipment to be assembled safely. A minimum of 3 meters wide by 1.5 meters deep is required. Absolutely no liquids or fire hazards are to be placed on the DJ/performers table or equipment provided before, during and after the performance.
Run sheet / Timeline
It is the Client’s responsibility to provide Premier DJs with a timeline, run sheet, schedule, itinerary etc a minimum of 7 days prior to the event date.
Special Songs
The parties agree to log in and fill out a the Wedding Planning Form and Music Request section of the online client portal. Required song selections include, but are not limited to, the Bridal Party Entrance, Cake Cutting, Bridal Dance, Father Daughter and Mother Son Dances, Bouquet and Garter, and Farewell songs. These will all be submitted in the system no less than 14 days prior to the wedding date. Any special details regarding these songs or details of the event are also to be advised.
Pre-Event Confirmation & Music
The Client agree to a pre-event confirmation before the Event in order to confirm the details for the day including times, location, and Client’s request list (via client portal) for specific songs. The Client will be responsible for, or have someone designated, to provide this list of specific songs if they are desired no less than 14 days prior to the event date. Premier DJs will not be held accountable for not having songs requested on the night, should they not be informed by the pre-event confirmation. It is NOT required for the client to schedule a pre-event consultation before the event date to finalise details. Premier DJs can successfully communicate all event confirmation details via email or phone.
Event Food Service
In accordance with Australian workplace law, the Client agrees to provide a meal for the Premier DJs team member for events over 4 hours.
Limit of Liability
In the unlikely event of severe medical, natural, or other emergency it could be necessary to substitute a different DJ. Premier DJs will make every effort to secure a skilled replacement DJ. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the Event Package booked. Premier DJs take the utmost care with respect to exposure, transportation, using professional grade equipment and professional grade backup equipment. However, in the unlikely event that there is an issue for reasons within or beyond Premier DJs’ control, Premier DJs liability is limited to the return of all payments received for the event package.
Equipment Failure
Premier DJs uses and maintains equipment of high quality, however in the unlikely event that time is lost due to Premier DJs malfunction, Premier DJs will either refund the portion of the total amount, or extend the booking to correspond to any significant time lost. This is the extent of Premier DJs liability. All equipment used is checked prior to arrival and has been fully tested for safety by a qualified electrician. If Premier DJs are linking equipment within a fixed in-house audio system, Premier DJs reserve the right to refuse to do so if the equipment is considered to be unsafe or liable to cause damage to any component linked to it. The Client is liable if post inspections prove that damage has been caused by faulty equipment other than that used by Premier DJs.
Substitution
In the event of illness or sudden event out of the control of both parties, Premier DJs will attempt to substitute a DJ at no cost to client. This contract will be transferable to said DJ.
Outdoor Events
Sufficient cover from the elements must be provided for Premier DJs for the duration of the event. Notification of type and size of cover is required a minimum of 14 days prior to the event. Should this not be provided, an additional fee will be added to the invoice to cover hire costs of suitable cover. An inclement weather plan is to be provided to Premier DJs in writing a minimum of 14 days prior to the event. In the case of inclement weather, Premier DJs will do everything possible to continue performance, however Premier DJs reserve the right to modify or cease service in the case of unsafe weather conditions. Where relocation of equipment is required, there will be no refund for the time lost during this transition. In the event that service must cease due to weather, no refund is applicable.
Access to Power
The Client shall ensure that the venue has adequate provision of clean electrical power and will provide a minimum of 2 standard 240V electrical outlets dedicated purely for our equipment within 3 meters of where the DJ is to be set. Any damage caused to our equipment by an inadequate power supply or power interruption is the responsibility of the Client; the Client is fully responsible for any damage caused to the equipment caused by the use of noise limiters and the subsequent cut off and reintroduction of power at the venue without our consultation. Should the venue not have adequate provision of power for Premier DJs usage, then notification is required upon booking and an additional fee of $215.00 will be added to the invoice for the hire cost of a suitable generator. If the generator is being supplied by the client (or other provider), the generator MUST be 240v at 50Hz with a minimum power rating of 2.0 kVA. The generator MUST be pure sine wave only (not modulated). If the generator is not to be for the exclusive use for Premier DJs, the Client must advise Premier DJs of this upon booking. Provision must be made for the generator to be placed outside of any enclosed areas for safety from emissions. Wet weather will cause the cessation of use of the generator as it is unsafe to continue to operate in rain.
Power Outages
In the event of any power outages (where the power source has been provided by the client or the venue), the client is not entitled to any refund for the time the power is down. Premier DJs will refund (or extend time pending venue approval) for any time power is down when Premier DJs have provided the generator.
Model Release
The Client hereby grants Premier DJs and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs and/or video of the Event, its guests, attendees, and officials for editorial, trade, advertising, stock, commercial and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases Premier DJs and their legal representatives and assigns from all claims and liability relating to said photographs and/or videos.
Severability
If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.
Cooperation
The parties agree to positive cooperation and communication.
